On our campus, mutual NCOs are only used if the survivor does NOT want to go through a formal Title IX process. Since the accused student does not have the ability to respond to the accusation, a mutual NCO order is issued as an 'equitable' interim measure. But to clarify, informal processes aren't allowed for complaints that include physical violence, so we never provide mutual NCOs after a report of sexual assault, typically only harassment or stalking.

Here is an article that talks about the harms of mutual orders, although it is in the context of the courts, I believe there are similar issues for campuses. My biggest concern is that it becomes one more reasons victims of relationship violence would choose not to report the abuse. As the article says, victims are safer not having any no contact order versus having a mutual order.

Subject: Mutual No Contact Directives?
Hello All,
I wonder if your institutions issue no contact directives after reports of sexual assault or domestic violence. If they do are those orders mutual? I have concerns about no contact orders being issued against students/ survivors who have not been accused of any policy violation. Your thoughts?
Best,
Denise
