I think Daniel is right about some of the forces that got that piece in there.  I also suspect it is related to the comments during the roundtable on June 23 about the need for law enforcement to be trained in forensic interviewing.  Although it does seem law enforcement-ish, I am not sure it was intended that way—I think it was more .  Boxer’s bill doesn’t include the forensic interview piece.  I would encourage those of you who are inclined to do so to let your Senators and Congresspeople know your opinions on the various options here—we are all citizens with that right, and you all have particular expertise that would be helpful to lawmakers.  There is also an opportunity to encourage your schools to weigh in, either the one at which you work or the one(s) from which you graduated (if, of course, you think your schools will weigh in the right way!), so you may also want to do that.  Finally, op-eds and letters to the editor in your local paper would help advance your perspective and expertise with your reps to Washington and the general public.

 

Regarding the confidential advocates already on campus, there were efforts to codify the OCR FAQs’ multiple-path reporting structure (but not allow the types of employees who have confidentiality to be designated at the discretion of the school), which resulted in provision (3) beginning on pg 14, line 22.  That provision essentially authorizes the Dept of Ed to make rules that define which employees on campus will be designated as confidential.  If the bill is passed, there will be a rulemaking determining that question.

When I read the language, on page 14, it seems that the goal is ultimately some type of prosecution, either criminal or student conduct. I'm worried this is going in a direction of interrogation, unintentional or not. And what will happen to confidential advocates who just need to process with students instead of fact-find?

The “forensic” interview is, I believe, a part of this. Wow...are they thinking the campus advocates would do this, or another person who is trained to conduct interviews?  I am picturing a Title IX-like investigator who happens to be confidential.  If the expectation is current advocates, I am a little, well, speechless.
