As an advocate I have sat in on several Title IX investigations. Both the Dear Colleague Letter and Campus SaVe outline the right for both parties to have advocacy. Although may not speak/ represent student.
Our SA policy also states the right to advocacy.

Hi Megan,

That is really surprising to me, as that would be a violation of a survivor's right to accompaniment. There are frequently local statutes that codify this, but Campus SaVE also specifies that
  • Both parties may have others present during an institutional disciplinary proceeding and any related meeting, including an advisor of their choice
In sexual misconduct proceedings, I typically serve as a survivor's advisor through the entire process from initial investigation meetings through the hearing and any subsequent meeting.  I do now that outside counsel is often not allowed as campus proceedings are not legal proceedings and having attorneys for one student and not the other can create a perceived or real power imbalance.

My best,
LB

Quick question,

For those of you who operate as advocates on campus, have you ever accompanied a student to a Title IX investigation interview, or would you be allowed to if the student asked? Our Title IX Coordinator is telling us that a student is not allowed to have anyone in the meeting with her, including the student’s attorney, and we’re not sure if that’s a Title IX thing or that’s specific to UW.

Thanks!
