Thanks to Dan Carter for alerting us to the proposed changes to the Clery
Act.
I get nervous when this particular Congress starts talking about removing
reporting requirements in this area.
On both of the suggested changes, I think it would be better to ask the
proposed measures to be tabled for now, and to work with legislators instead
to
develop requirements and language that work in those circumstances (foreign
schools and trade schools) rather than throw out the requirements entirely.
There have been cases where US students on exchange did not get the treatment
they should have or warnings they might have because their US institution
shrugged its shoulders at the difficulty of making sure protections against
assault followed them to the host institution.
A better amendment to the Act as a whole, in my view, would be to build in
lesser penalties than loss of all federal funding for different stage
offenses.
The maximum penalty means essentially little to no enforcement, and I think
college administrations are starting to figure that out, especially under the
current DOE and administration.
