Katie,

Your policies may allow you to do an interim suspension -- is it in your
Student Handbook? This will allow you to remove the accused student from the
institution pending the outcome of the hearing. Sometimes it may be
sufficient to take an intermediate route, banning the accused student from
having access to certain buildings or contact with certain individuals -- for
example, a "no contact" order with the accuser. I am not entirely certain
what you meant by "access issues" but perhaps this answers your question. In
any event, it is good to review your handbook materials regularly and to
consider spelling out options such as these.

Best,

Ray

Subject: college policies against person with charges pending

I know this issue comes up all the time but I was wondering how other schools
deal with access issues with a student who has charges pending against him
for sexual assault against another student at a school-related outing. We do
not have a set policy in place for denying access to the accused until he is
found guilty. We have our own disciplinary hearing procedures but they are
not immediate.

Thanks.
