Although the Hate Crime reporting requirements under Clery were recently
expanded, as of August 14th, they still deal with incidents that rise to the
level of certain specific crimes.

One of the new crime categories, however, is intimidation. This is defined
as "to unlawfully place another person in reasonable fear of bodily harm
through the use of threatening words and/or other conduct, but without
displaying a weapon or subjecting the victim to actual physical attack."

Some of the types of incidents I've heard about recently might, under the
right circumstances, rise to this level and be an actual hate crime that is
now reportable under the Clery Act.
