 Federal guidance related to Title IX  can be found at
http://www.ed.gov/offices/OCR/archives/pdf/shguide.pdf.  Several topics
discussed here "confidentiality" ; what constitutes"notice" and what
constitutes appropriate response to a complaint are all outlined in this
guidance( and subsequent case law related to its interpretation.)
According to the interpretation our lawyers made of the guidance
"confidentiality" can only be held by those employees who have
privilege- such as medical professionals, licensed therapists,
ministers, and certified sexual assault counselors  supervised by the
local rape crisis centers.  WE specifically do not pay our student
advocates so they will not be considered "employees" and are not
therefore obligated to report; Resident counselors  as employees can not
assure confidentiality as they are obligated to report incidents if they
have enough information to do so.
Does someone have other information that is different from this?

it is not true that school officials need to have  known of the harm in
order to comstitute sexual herassment.knowledge is only a factor re
schools liability.i wrote the first law review on the topic of sex
assault and title ix and will send reprinta apon request.Wendy Murphy
