Supplementing what Julia shared, the preamble to the final VAWA rule notes:

In response to the question about whether an institution must require mandatory attendance at primary and ongoing prevention programs and campaigns, we note that neither the statute nor the regulations require that every incoming student, new employee, current student, or faculty member, take or attend the training. 

The regulations require only that institutions offer training to all of these specified parties and that the training includes the contents of § 668.46(j)(1)(i)(A)–(F) and meets the definition of ‘‘programs to prevent dating violence, domestic violence, sexual assault, and stalking’’. 

Institutions must be able to document, however, that they have met these regulatory requirements. 

Although the statute and regulations do not require that all students and employees take or attend training, we encourage institutions to mandate such training to increase its effectiveness. 

Lastly, the final regulations do not require institutions to maintain statistical data on the frequency, type, duration, and attendance at the training, although if an institution believes that maintaining such data is informative, we would encourage such efforts.

Bottom line, offering the training is mandated by VAWA, mandating your constituents to take/attend the training is not. However, you are encouraged to “mandate” such training as the department believes a mandate of such training “increases its effectiveness”.

I have always marveled at this language. Hopefully the brings clarity to  the “mixed message” challenges.

The Violence Against Women Act amended the Clery Act in 2013 to require that we offer education to all incoming students, but it does not require that we show that they actually completed the training.  See page 2 of this checklist: https://www.calcasa.org/wp-content/uploads/2014/05/VAWA-Amendments-to-Clery-Checklist-v.2.pdf.

Hello all,

 

I am inquiring to get more information on where I can find information about what sexual assault prevention is mandatory/required for graduate students.  To my understanding, they are supposed to be offered training and resources, but are not mandated to attend a structured training like the first years are.  I am getting mixed messages, and just want to be clear.
