Hello Juliette (and all),

Yes, the University of Michigan includes a section on sexual exploitation in its Sexual and Gender Based Misconduct Policy. I have included the language below:

2. Sexual Exploitation Sexual Exploitation is intentional conduct by which an individual takes or attempts to take non-consensual sexual advantage of another for one’s own benefit, or to benefit anyone other than the one being exploited.

Examples of Sexual Exploitation include the following: ● Intentionally or knowingly causing the Incapacitation of another person (through alcohol, drugs, or any other means) for the purpose of compromising that person’s ability to give Consent to Sexual Activity; ● Intentionally or knowingly engaging in voyeurism, including observing or allowing another(s) to observe private sexual or intimate activity (e.g., disrobing, bathing, toileting) without the Consent of the individual(s) being observed, whether from a hidden location or through electronic means (e.g., Skype or livestreaming of images); ● Intentionally or knowingly recording or photographing, or disseminating or posting images of private sexual or intimate activity and/or a person’s intimate parts (including genitalia, groin, breasts and/or buttocks) without Consent; ● Intentionally or knowingly, without Consent, engaging in the recruitment, transportation, harboring, or receipt of a person(s) for the purposes of a commercial sex act(s); ● Intentionally or knowingly demanding financial compensation, Sexual Activity, or some other benefit under threat of disseminating or posting an image, video or other recording, of private sexual or intimate activity and/or a person’s genitalia, groin, breasts, and/or buttocks; ● Intentionally or knowingly exposing another person to a sexually transmitted infection without the other’s knowledge; and/or ● Intentionally or knowingly, through one’s actions, aiding or assisting another person in committing an act of PROHIBITED CONDUCT.

thank you so much for sending this Molly. For those of you with similar policies, are you seeing students using the policy? We know how prevalent this is - especially at the middle and high school level and as we know, it's almost always the person in the photo who suffers the consequences as opposed to the jerk who sent it around...would love to know if college students are feeling invited and validated to use that policy...

Thanks!

Hi Juliette (and all),

Our policy at UW-Madison was updated a few years ago to included "sexual exploitation," under which sending pictures without consent/knowledge is included.

Here's the definition of "sexual exploitation," as well as a link to the broader policy.

Sexual Exploitation

Attempting, taking, or threatening to take nonconsensual sexual advantage of another person. Examples include:

  1. Without the knowledge and consent of all participants:
    1. Observing, recording, or photographing private body parts or sexual activity of the complainant;
    2. Allowing another person to observe, record, or photograph private body parts or sexual activity of the complainant
    3. Otherwise distributing recordings, photographs, or other images of private body parts or sexual activity of the complainant;
  2. Masturbating, touching one's genitals, or exposing one's genitals in complainant's presence without the consent of complainant, or inducing another person to do the same.
  3. Dishonesty or deception regarding the use of contraceptives or condoms during the course of sexual contact or sexual activity;
  4. Inducing incapacitation through deception for the purpose of making the complainant vulnerable to non-consensual sexual activity;
  5. Coercing the complainant to engage in sexual activity for money or anything of value;
  6. Threatening distribution of the following, to coerce complainant into sexual activity or providing money or anything of value:
    1. Photos, videos, or recordings depicting private body parts or sexual activity of the complainant, or
    2. Other information of a sexual nature involving the complainant, including sexual history or sexual orientation.

Hey all -

Does anyone know of any campuses that have included sending nude pics without the persons consent into their campus (preferably sexual assault) policy?

The University of Michigan is located on the traditional territory of the Anishinaabe people.  In 1817, the Ojibwe, Odawa, and Bodewadami Nations made the largest single land transfer to the University of Michigan. This was offered ceremonially as a gift through the Treaty at the Foot of the Rapids so that their children could be educated. Through these words of acknowledgment, their contemporary and ancestral ties to the land and their contributions to the University are renewed and reaffirmed.
