I begin with my standard greeting these days and send my wishes that all of you and your loved ones are starting to emerge from the pandemic healthy, vaccinated, and as unscathed as any of us can be after what we have faced and may have yet to face!
Although this email will seem quite similar to those of you who received the one I sent in March 2020, I promise it includes new information, so I hope you will stick with me to the end! First, I am happy to announce that I am lateraling to Wayne State University Law School. Those of you who know my California Western School of Law colleagues will not be surprised to hear me say that I feel incredibly fortunate to have spent the last year working with them, and I look forward to hearing about the great things I expect them to do in the coming years. I am likewise very excited to be joining Wayne Law and getting this chance to work alongside so many Wayne colleagues whose work I have respected and admired for many years. My Wayne Law email is (this email will continue to work as well).
Second, I am equally happy to announce that the Big Comment Catalog is within a few thousand comments of completion, just in time for the comprehensive review of the Title IX regulations that the previous administration finalized in May 2020, which President Biden ordered on International Women's Day of this year. The Department of Education subsequently announced the steps it would take to implement this Executive Order on Guaranteeing an Educational Environment
Free from Discrimination on the Basis of Sex, Including Sexual Orientation or Gender Identity, including by scheduling virtual public hearings to be held this week.
By encouraging students, interns, colleagues and friends to volunteer to catalog comments, and/or by signing up to catalog comments yourselves, you can help get the Big Comment Catalog completed in time for it to be useful in the review being undertaken right now.
For more information on the purposes of the catalog and to sign up to catalog comments, please go to the Big Comment Catalog website (https://sites.google.com/view/title-ix-comment-count/home) and/or read this short blog post from Karen Tani, Matthew Cortland and myself: Reclaiming Notice and Comment: Part II - LPE Project. The National Women's Law Center has also created a Guide to Title IX Public Hearing on how to submit an oral or written comment at the public hearings this week. Finally, there are several coalitions preparing comments for this week's hearings onto which individuals and organizations can sign. So far, these include: an NWLC-led comment on sexual harassment on behalf of survivor advocates and civil rights organizations; a GLSEN-led comment on anti-LGBTQ discrimination and sexual harassment on behalf of civil rights organizations; and a Federal School Discipline & Climate Group-led comment on discipline of sexual assault survivors on behalf of organizations that work on school discipline. Other coalitions are expected to add comments to this list, so if you are interested in potentially signing one or more of these comments or learning about whether other coalition comments have been added, please email me and I will get you access to those comments. All will close for signature sometime on Friday, June 11.
For those of you who replied to my March 2020 email and never heard back from me, I apologize for my silence and note that I learned my lesson the last time and have therefore quite deliberately waited until now to send this email so that I would be better able to respond to any replies. Given the coalition comments information shared above, I am also aware that I need to reply quickly to anyone seeking more information or to sign those comments.
I end this message mainly as I began it: with best wishes for everyone's health as we pull through to the end of this pandemic, but with the additional plea to volunteer and/or recruit others to volunteer so we can complete the Big Comment Catalog in time for it to be useful for the current Biden administration review.
Best,
Nancy
