Hi Chad, 

I suggest if student workers are made responsible employees, then follow other institutions, like I believe U of O, where they hang a sign or plaque on the RAs door explaining they are a responsible employee. Students don't understand when they are talking to an RA that they are responsible employees. They barely understand when they disclose to faculty that their information will be shared because faculty often say, "don't worry this is confidential" - when that's not true. I spend a lot of time trying to train staff, and faculty not to say that and refrain from offering confidentiality when you don't have a privileged relationship with someone because you are offering something you cannot provide. 

This has always been a point of contention with me because it's likely this person has already had their trust violated, and had not been in control of a situation that happened to them; potentially now, trust will be violated a second time and they have lost control of the information...I can explain more off-line if you want to chat. But in short, if you make students responsible employees, make it clear to other students. Students just think they are talking to a friend or peer, and it's really not fair to survivors when they lose control of their own information, and the freedom to report or not report, or the ownership over what happens to their story.

I hope my email finds you well during this challenging time.  While I understand confidentiality has a more stringent definition than privacy with regard to Title IX reporting obligations, I’m curious what offices, individuals, and/or student leaders/groups (other than RAs) campuses have identified as private.  I’m especially looking to gather information on student leaders and/or peer education groups with regard to Title IX reporting obligations?  Any insight is appreciated.  Be well!
