I am not a lawyer, but everything I read about this has to do with Digital Millennium Copyright Act of 1998. There may be other legal avenues to pursue, so I strongly recommend direct consultation with a lawyer. There are certainly practical guides out there whose authors purport to be experts in the field, but I'm not in a professional position to evaluate them.
I have found the folks at the National Crime Victim Law Institute to be extremely helpful in situations like this, especially when the survivor does not have access to counsel. I recommend that you start there!

P.S. I would appreciate if you could send me anything you get that is not on the listserv. We are figuring this out in West Virginia, but the process will be lengthy and difficult.
I have a client who is looking to file copyright on some photos she sent to an ex, and I’m not sure how to go about that process. Has anyone done this before, and if so get in touch?
