Wade,

I’m still in the process of reviewing the document, but most of the changes seem relatively minor. Examples of changes include requiring institutions to include points of contact for filing disciplinary complaints and seeking accommodations, and eliminating the counting rule in stalking cases that created a new statistic if there was an intervention and the pattern continued afterwards. Probably the most significant change, as it was not even discussed during as part of Negotiated Rulemaking, is a new requirement that institutions report statistics on the number of “unfounded” (i.e.. false or baseless) crime reports. According to the Education Department this is intended to address a concern that some institutions may improperly deem a report “unfounded” so they can exclude it from the statistics.

Were there any major changes since the consensus version of the regulations in April? Is there a mark-up copy comparing them if so?

The U.S. Department of Education this morning released the final implementing regulations for the Campus SaVE Act/VAWA amendments to Clery on the Federal Register website at the link below. They will be formally published on Monday and take effect July 1, 2015.
