Please forgive the cross-posting but I think both lists would have some input.
Looking at the sexual conduct policies and hearing procedures that other schools use, it struck me that whereas some, like us, state all the procedures our board will use in
a hearing (acceptable vs. unacceptable evidence, prior sexual history, etc), some do not, saying things like “our sexual conduct boards function substantially similar to other hearing panels”.
My question is, in the realm of best practices, which is better, and are they both safe?
When Howard Kaellem (OCR’s DC Enforcement Office) spoke at a conference last year, he said that when there is a Title IX investigation of a school, the first thing he looks
up are the published policies on the website. Therefore, I concluded it was best to set out in detail what we will and won’t do in a hearing to show that we are compliant with Title IX and the DCL.
What is your wisdom on this?
