John, Beginning with the 2014-2015 academic year colleges and universities will be required to provide “Education programs to promote the awareness of rape, acquaintance rape, domestic violence, dating violence, sexual assault, and stalking, which shall include…primary prevention and awareness programs for all incoming students and new employees”. The Negotiated Rulemaking Committee currently working to develop proposed implementing regulations is evaluating the extent to which institutions may need to ensure that “all” new students receive the programming. The deadline to implement the new provisions is October 1st, the usual Clery Act deadline. Until “final regulations” are issued by November 1st, taking effect July 1, 2015, the U.S. Department of Education has said they expect institutions to make a “good faith” effort to comply, so there will not be explicit guidelines in place until the 2015-2016 academic year.
