Schools have plenty of freedom to talk about "the handling" of sexual assault matters without violating FERPA. Dan's explanation lays out the breadth and limitations, including that it is proper to discuss virtually everything EXCEPT information personal to the students involved, unless they consent. This lockdown re: all inormation is wrong because total silence is almost always overinclusive. Schools can and should try harder to say more about their policies as well as specfic information about the nature of the harm, risk to others, etc. If a student were attacked based on race, and the story made news, I suspect the school's response would include all nonFERPA protected information in order to quell public concern about racist violence, racism etc., and to ensure the relevant communities that specific policies and procedures are in place to deal with the issue. This school's response implies falsely that they can't say anything at all. Imagine the public reaction if the police in the real world had a similar lockdown of information approach when crime happens. The public's right to know about violence is not lessened by the fact that a public offense occurs on a college campus. Crime is crime no matter where it happens. Schools that overindulge rules that limit access to information will only inspire victims of campus crime to report FIRST and maybe ONLY to outside authorities.
