For what it's worth
I've handled many similar cases and insurance companies always assert as a
defense that a mom is contributorily negligent? -
I've sued au pair agencies, for example, for negligent hiring of dangerous
nannies who then raped or abused the children they cared for - - and the
insurance company lawyers always claim that the parent was negligent in some
fashion
women who sue landlords, etc - who claim negligent security allowed the
offender to get in the home also get sued for their own contributory
negligence - as do women who sue for intentional tors and are drunk at the
time -
i'm not sure why this case was so surprising to people - it's quite common
insurance defense strategy in my experience
