Dear colleagues,
As we move through our discussions of policy development for issues of
interpersonal violence we came across an issue at one of the 3 institutions
we are working with. Currently, at this institution, if a student reports a
sexual assault to the campus judicial officer - so the entity responsible for
student code of conduct - that staff member is then mandated to report this
to the Sexual Harassment Officer for the school who resides in HR. HR then
does an investigation that can last up to 2 months on whether the perpetrator
is responsible or not responsible for violating the student code of conduct -
the judicial office and/or campus police does not do this investigation.
A student is then caught up in an HR/employee process regardless of whether
they are an employee or whether the perpetrator is an employee. I am
wondering if any other campuses do this and what, if any, are the best
practices around having students (non-employees) go through an HR process for
sexual assault. If the Sexual Harassment officer finds no violation then the
campus judicial office cannot adjudicate it.
