This isn't so much a Clery question as a question of the law in your
specific jurisdiction. Clery doesn't govern how you respond to a crime
rather it requires statistical disclosure of specified crimes that are
reported to campus security authorities or local police. It doesn't matter
who disclosed the incident to one of those authorities and the U.S.
Department of Education even specifically lists offenders as possible
reporters.

In order to effectively comply with Clery institutons need to adopt, as
Fredonia has, a policy to collect information from campus security
authorities to report statistics and consider whether or not to issue a
timely warning. This policy structure should be noted in a disclosure in the
Annual Security Report as well as whether or not "confidential" not to be
confused with anonymous reports are accepted. It sounds like Fredonia has a
good confidential reporting program in place where the CSA knows who is
reporting but that isn't passed on to the police.
