I'm urging the folks in Maryland to seek further appellate review and I
expect they will win a reversal of the silly idea that a person loses the
right to change their mind after intercourse has begun
I wrote an amicus brief on the issue in a California case a few years back
and the court there agreed with my position that the fundamental right of
autonomy menas nobody ever "signs away" authority over their body -
My favorite debate on the issue involved me and bill o'reilly who said "but
wendy -- the train's out of the station" -- and i replied "bill -- assume you
and I are engaged in an act of intercourse and YOUR t rain is back in but MY
train is still out -- under your theory of law, I could make you keep going"
--
when i teach autonomy to my students and i use my o'reilly discussion to make
this point -- all the guys in the class say "AHH -- now i understand
autonomy" --
