I was gratified to read Robin Garrett's response. She is right, of course,
that there are some schools and some individuals doing exceptional work and
that it is a mistake to ignore them when we assess the overall situation.
But, Robin Garrett used a phrase that I think is very destructive and that I
suggest we stop using. She wrote "Even in "he said-she said" cases . . ."
This is a very minimizing and inaccurate phrase that defense attorneys (and
excuse-making prosecutors) love. In fact, most cases in the criminal justice
system involve credibility assessments. It has not been my experience that
sexual assault -- as opposed to, for example, robbery -- is less likely to
have
extrinsic proof. But I have never heard anyone refer to a mugging as a "he
said/she said" or a "he said/he said" case.
