Eliminating Force From Campus Sexual Misconduct Policies: The Rise Of The Consent Construct
has a section called "everything you need to know about consent" that lists many factors that comprise consent and mitigate consent.
Brett is also working on a paper that makes an argument for adjudicating sexual assault cases that moves from determining force>determining coercion>determining consent and arguing that you stop the hearing wherever in the progression you find that force was present or coercion was present and only if there was no force or coercion do you move on to discuss consent. That should be on his website this spring. It's an interesting idea.
