i have a list i've compiled of numerous privacy rights -- but it is not
available on this computer so i can only fax it -
it lists about 40 privacy and confidentiality rights applicable in
massachusetts -- though many are federal laws which apply in all
jurisdictions.
if you backchannel me a request, i will fax you the list. I give it out at
the trainings i do on confidentiality and privacy rights and i encourage all
who work with victims to give them a copy, too -- so they will know their
rights and will at least have an opportunity to protect their rights even
without legal representation. there's nothing better than having a victim
cite a statute or a constitutionally-based federal court ruling when police,
prosecutors or defense counsel try to get them to reveal irrelevant personal
information.
this is not just an abstract exercise in learning about privacy rights. the
top two reasons cited by victims as to why they refuse to report rape and
participate in the criminal justice system are: fear of being blamed and fear
of being shamed. both reasons derive from concerns related to privacy rights
thus, if we do a better job helping protect victims' privacy rights AND
empowering victims with the knowledge and power to insulate themselves from
gratuitous privacy intrusions, more women will report rape and participate in
the justice system because the reasons NOT to participate will be diminished.
