The problem I have with the proposed changes is that it feels like they are going in the wrong direction. We have been fighting in this work to get universities to redefine the term "campus" more broadly so that they still consider it campus sexual assault if it occurs, for example, in off-campus housing. Plus, if we let trade schools and community colleges off the hook because they (at least as they claim) have no campus, then haven't we loosened their obligations to keep safe, for example, parking lots and labs, where students are often along at night. Similarly, we have been working hard to secure remedies for students spending a semester abroad who often have virtually no recourse when their safety is violated. Doesn't the specific exemption of foreign universities just make this situation worse? if not at law than at least implicatorily? It also does not seem to me that we should take any Clery Act standards from the inaction's of the Department of Education. Isn't it their historic failures which led to the first revisions of the Clery Act?
