Jury Finds Professor Liable for Sexual Harassment Based on
Videotape Evidence

A federal jury in Philadelphia on Friday found a West Chester
University of Pennsylvania professor liable for sexually
harassing a student, who proved her accusations, in part, with
a videotape she had secretly made with a tiny camera concealed
in a notebook. The jury awarded her damages of $120,000 after
the judge absolved the university of liability.
The professor, Jamal Ghoroghchian, a former chairman of the
chemistry department, tried to touch and kiss the student when
she went to his office for academic help some three years ago,
according to court documents. With the door closed, he offered
to give the student, Jurgita Pociute, better grades if she
would have sex with him.
Neither Mr. Ghoroghchian nor his lawyer could be reached for
comment on Friday. The professor has denied any wrongdoing,
but he has acknowledged that his hand might have inadvertently
touched Ms. Pociute's breast.
A student from Lithuania, Ms. Pociute was taking chemistry
classes in 2000 to prepare for dental school. Her lawyer,
Nancy C. DeMis, said that Ms. Pociute is no longer at the
university.
Ms. Pociute, who took two chemistry courses with Mr.
Ghoroghchian, was afraid that university officials would not
believe her version of events. So she returned to the
professor's office with the concealed video camera and asked
him to write her a letter of recommendation, the court
documents say. During that meeting, Mr. Ghoroghchian reached
under her shirt and groped her breasts. The jury's award was
for that incident only.
"The case reflects a tragedy for all of the parties," said Ms.
DeMis. "It's a shame that it had to be brought."
The university conducted an investigation of the incident and
found that Mr. Ghoroghchian had violated its sexual-harassment
policy. He was given a confidential letter of reprimand and
ordered to attend a private training session on avoiding
sexual harassment, which he did.
University officials could not be reached for comment on
Friday.

Hi, Thanks for helping with the Campus Rape Support Project (CRISP).
If you have already taken an on-line survey, we would like to know what STATE
you are from (you don't have to remember your pin number) . If you took the
survey before November 11, 2003, then there were no identifyers on the survey
to help us track location. Participants can e-mail me or can go back to the
website, fill in the state on the first page of the survey, and press SEND
at
the end. If you return to the web site but FORGOT your pin, you can make up
a
new one, but must use the letter "B" in a 4-digit pin. Do not fill out the
survey again, just your state and/or telephone number.
We are still looking for more volunteers to participate in surveys and
interviews who have had experience with college students and know anything at
all
about campus rape as a problem or support services for students. They need
not
be working on campus. This includes advocates, teachers, physicians, nurses,
lawyers, mental health professionals, etc. The website for people who have

I'm interested in knowing how the action taken against this professor as =
a result of the university's investigation compares with what degree or =
form of action would typically have been taken on other campuses. Some =
of us are asking the question, "What would a professor have to do that =
would result in his or her being fired?" Thanks for any info you can =
give me on this.

I would also suggest looking at how businesses handle sexual harassment.
They set up policies on sexual harassment decades ago and deal with an
incident quickly in order to limit company liability and fairness to
employees.
