Penn Professor to Stand Trial on Rape and Drug Charges

A University of Pennsylvania professor accused of drugging and
then raping a woman in his office last September has been
ordered to stand trial after attempts to negotiate a plea
bargain failed.
Tracy McIntosh, a professor of neurosurgery who directs the
Head Injury Research Center at the university's School of
Medicine, was accused of raping a 23-year-old woman. The
woman, a niece of one of his friends, was about to start
graduate school at Penn.
At a preliminary hearing on Thursday, the woman testified
that, after vomiting during dinner with the professor, she
returned to his office feeling groggy. She said Mr. McIntosh
gave her marijuana to smoke and then forced himself on her.
Mr. McIntosh, who is 49, did not testify at the hearing, but
his lawyer, Thomas A. Bergstrom, said the professor planned to
plead not guilty at his arraignment, which is scheduled for
July 31. "Our position is that he did not rape this girl," the
lawyer said.
The charges against McIntosh include rape and misdemeanor
marijuana possession.
Thursday's hearing had been postponed several times during the
spring while prosecutors and Mr. McIntosh's lawyer talked
about the professor's pleading guilty to some lesser charge.
Mr. Bergstrom said they were close to reaching an agreement,
but then "the DA sort of pulled the rug out from under us."
At the hearing, a Drug Enforcement Administration officer
testified that an audit of the professor's medical supplies
discovered that a small amount of sodium pentobarbital was
missing. Another scientist testified that the drug, which is
used to euthanize animals, has a sedative effect.
Mr. Bergstrom called the idea that Mr. McIntosh had drugged
the woman "ludicrous" and said the audit was mistaken. "There
is a complete accounting by Penn of every drop" of the drug.
University officials said they had investigated the rape
allegation internally but could not corroborate it. Mr.
McIntosh took a leave from Penn in April.
