At the top of the list of items to consider when drafting P&Ps re sexual
assaults on campus:
Give victims a list of private attorneys not affiliated with the college or
university. Pro bono organizations like mine, the Victim Advocacy and
Research
Group, exist all over the country but students are never informed of this
option.
Victims need outside legal counsel so that they can be apprised of all their
rights, under the Campus Victims' Bill of Rights, under any state law
analogue
- "Victims' Bill of Rights, under the federal constitution, Title IX, the
Clery Act, options regarding civil lawsuits, criminal prosecution,
restraining
orders, et.- and - - victims need to know that they have due process rights
that, because of Title IX, are more weighty than the rights of the accused
(the
accused student has no federal constitutional due process rights at stake in
a
private education, but the victim DOES have a constitutional due process
interest b/c of the civil rights aspect of gender-motivated violence).
Victims also need to be apprised of their rights to privacy, and they need to
appreciate the consequences of revealing certain information as well as the
right to file complaints with the Office for Civil Rights with the Department
of Education and the Financial Aid office within DOE re clery violations.
These regulations have strict time limits about which victims need to be
informed
as quickly as possible.
Because of the obvious overlapping interests, college and university
officials should NOT be responsible for advising victims of their rights or
helping
them to seek enforcement.
Remember, at Harvard, students started their fight for change several years
ago by trying to work WITH administrators and by working cooperatively to a
mutually satisfying end. During this time, the school initiated its own
"study"
of the "problem" without advising or even speaking to the students with whom
they were purportedly working in a "cooperative" manner - -
When this secret study led to the issuance of an equally secret "report" that
urged the adoption of the ridiculous "sufficient independent corroboration"
rule, the students tried to persuade Harvard to rescind the rule, but they
refused.
The students were only successful in forcing Harvard to rescind the rule by
using the outside influence of the Office for Civil Rights. Because of this
outside source of accountability, Harvard removed the word "independent" only
one month after OCR's formal investigation got underway. Then, Harvard
removed
the words "sufficient" and "corroboration" before OCR agreed the matter had
been resolved and there was "no" violation of Title IX.
The best evidence of the need for outside influence and education around the
legal rights of campus rape victims is that when Harvard students first filed
their complaint with OCR, one administrator actually said publicly that the
complaint had nothing to do with Title IX - -
If this is what administrators think, just imagine what they must be telling
students.
Student victims - need to know their rights before anything else happens
because knowledge of their rights will have an impact on all the decisions
they
make about reporting the assault and all that follows. And - student victims
need lawyers - outside lawyers that have no allegiance to the college. This
is
not to create a contentious environment or to engage a fight - but rather, to
inform and protect the victim's well-being and her legal interests.
